'Govt failed to fulfil conditions laid down by SC'

JAIPUR: The Rajasthan High Court observed that the reservation
benefit, which was provided under Article 77, could not be allowed in
Rajasthan since the state government failed to fulfil the conditions
laid down by the Supreme Court in the M Nagraj case of October 2006.

The high court order was upheld by the Supreme Court in its order
dated December 7, 2010.

As the non-reserved categories' employees built pressure on the
government to implement the court order, a committee was constituted
to look into the matter.

The reserved category employees, on the other hand, demanded that the
government fulfill the conditions, especially collecting a
quantifiable data showing SC/ST's representation in the state
services, required to allow the reservation benefit in promotions.

The Samata Andolan Samiti, however, moved the contempt petition
alleging that the state government was allowing reservation benefit in
promotions to the SC/ST employees in violation of the February 2010
judgment.

Besides demanding that the judgment be enforced and the reserved
category employees be reverted, the Samiti sought for fresh seniority
lists of the state employees with their 'regained seniorities' from
June 17, 1995.
